Our Services

CPO Promotion

We use our experience of working on the promotion of numerous CPOs and our technical knowledge to guide clients through all stages of the CPO process, from conception to securing possession. We are a trusted advisor to numerous developers and local authorities, adopting a collegiate attitude when working with clients and the wider team to deliver on our client’s goals.

Claimants & Compensation

We specialise in the assessment of compensation when residential buildings, land and commercial property has been affected by compulsory purchase. We advise both acquiring authorities and claimants giving us a depth of experience in managing and assessing compensation claims and ensuring that the optimum outcome is realised and that accurate compensation budgets are constructed at the outset of a project. We act for all types of claimants, from large corporate funds and occupiers to independent business and property investors.

Land Assembly

We work with clients to advise on and help deliver high profile, complex projects, both through the use of a CPO and through purchasing land by agreement.

As well as the acquisition of property we are experts in advising on and negotiating the release of rights and covenants impeding the delivery of projects, such as restrictive covenants and rights to light. We are also experienced in the use of Appropriation / S.203 Housing and Planning Act 2016.

Expert Witness

We are experienced and proficient in providing expert evidence in compulsory purchase and compensation matters. Our staff have submitted expert reports and presented evidence at the Upper Tribunal (Lands Chamber), the High Court, and to Arbitrators/Independent Experts on a range of CPO and compensation matters. Our experience allows us to direct our clients though the process and make sure they receive the best advice to make fully informed, commercial decisions.

Restrictive covenants

We provide advice on the negotiated release of restrictive covenants including advising on premiums / compensation assessments. We are experienced in the use of statutory powers for their discharge and modification under S.84 Law of Property Act 1925 as well as the use of Appropriation / S.203 Housing and Planning Act 2016.

Rights to Light

We advise private landowners, developers and local authorities on the assessment of compensation relating to Rights to Light injuries. We specialise in both assessments under the negotiated damages approach for a share of developer’s profit, and the calculation of compensation when Appropriation / S203 Housing and Planning Act has been used to override rights

Appropriation

We advise local authorities, landowners and developers on the implementation of s.203 Housing and Planning Act 2016, including the assessment of compensation where rights, restrictions and contractual terms have been interfered with.
